Welcome to PSMarketplace, a service owned and operated by Fennec-IT (“we,” “us,” or “our”). These Terms and Conditions, together with the End-User License Agreement (EULA), govern your use of the PSMarketplace mobile application (the “App”) and the related services (collectively, the “Service”).
By accessing or using the Service, you agree to be bound by these Terms. If you disagree with any part of the terms, then you may not access the Service.
1. The Service and Marketplace Disclaimer
PSMarketplace operates solely as a technology platform connecting buyers and sellers for the sale of goods.
- We are not the seller or the buyer in any transaction.
- We do not own, inspect, or guarantee the quality, safety, legality, or suitability of any listed items.
- The Service is a venue; we are not responsible for delivery, performance, or disputes between buyers and sellers, which must be resolved between them.
2. End-User License Agreement (EULA)
Grant of License: Fennec-IT grants you a revocable, non-exclusive, non-transferable, limited license to download, install, and use the App solely for your personal, non-commercial purposes strictly in accordance with the terms of this Agreement.
Restrictions: You agree not to, and you will not permit others to:
- License, sell, rent, lease, assign, distribute, transmit, host, outsource, disclose, or otherwise commercially exploit the App or make the App available to any third party.
- Modify, make derivative works of, disassemble, decrypt, reverse compile, or reverse engineer any part of the App.
3. Account and User Obligations
Because PSMarketplace uses simplified authentication and relies on transactional integrity:
- No Password Required: We use simplified methods to access your account; you are responsible for maintaining the security of your device and access to the App.
- Accurate Information: You agree to provide and maintain accurate and complete personal and logistical information, including your full name, shipping address, and phone number, as required for the Service.
- Data Collection Policy: You acknowledge and agree to our collection of only your name, address, and phone number as detailed in our Privacy Policy.
4. Payment, Fees, and Transactions
- Instant Payment Confirmation: Payments processed through authorized methods (including Apple Pay) are confirmed instantly. Funds are transferred according to the policies of the third-party payment processor.
- Fees Structure: The price of items and delivery fee are determined by the seller.
- Review Before Payment: You agree to always review the item price, the variable Delivery Fee, and any applicable regulated taxes on the checkout screen before confirming payment. All transaction details are recorded and accessible in your Purchases screen.
- Payment Processor: You acknowledge that all payment processing is handled by third-party processors. We do not store your financial data.
5. Dispute Resolution and Support
- Order Issues: For any immediate issue concerning an order (e.g., item incorrect, missing), you must call the Support Hotline provided on our Support Center page.
- Buyer/Seller Disputes: Any disputes regarding item quality, non-delivery, or misrepresentation must first be addressed between the buyer and seller. While we may attempt to facilitate communication, we are not obligated to intervene or mediate.
6. Termination
We may terminate or suspend your license to the App and access to the Service immediately, without prior notice or liability, if you breach these Terms.
